Trial issues in Debt Recovery
You can essentially take them to trial in Debt Recovery. If the amount is under $5000, you can go to small claims court for debt collection. In small claims court ,you represent yourself, neither party is allowed to have an attorney present. If the amount that is due is over $5000 you can go to superior court. You could still choose to represent yourself, or you can have an attorney represent you in superior court.
Once you file a lawsuit and you serve the defendant with the paperwork of Debt recovery, they have 30 days to respond and file a written answer with the court. Once that 30 days comes and goes you can go into court and get a default judgment against them. That’s what I have here under item two, trial versus default.
